1. Who is selling<\/h2>\n

The website artechmotorsport.com and its online shop are operated by:<\/p>\n

2. Scope<\/h2>\n

These terms govern the distance sale of the products presented on the website. By placing an order you confirm that you have read and accepted them. If you buy as a consumer<\/strong> (a natural person acting for purposes outside their trade or profession), you also benefit from the protections of the Italian Consumer Code (Legislative Decree 206\/2005), which prevail over these terms in case of conflict. If you buy as a business (with a VAT number), some protections, such as the right of withdrawal, do not apply.<\/p>\n

3. Products and intended use<\/h2>\n

The essential characteristics of each product are described on its product page. Images are for illustration only: if you have any doubt about compatibility, connectors or versions, please write to us before buying.<\/p>\n

Important.<\/strong> Many products in the shop (standalone ECUs, modules and components for modifying engine management, intake, fuel injection and forced induction) are intended for competition use or for vehicles that are not driven on public roads, unless the product page expressly states that they are suitable for road use. Fitting them to a type-approved vehicle may make it non-compliant with its type approval and with the Highway Code, and may void the vehicle manufacturer's warranty. The choice of use, the installation and the vehicle's compliance with the law are the buyer's responsibility.<\/p>\n

Installation, configuration and tuning require specific skills. If you do not have them, contact us: we can advise you on how to proceed or arrange the service separately.<\/p>\n

4. Prices<\/h2>\n

Prices are in euro and include Italian VAT<\/strong> . Shipping costs are not included and are shown in the cart before you confirm the order (see the Shipping<\/a>page). For shipments outside the European Union, import duties and taxes may apply and are paid by the recipient.<\/p>\n

5. How the contract is concluded<\/h2>\n

To buy, add the products to the cart, enter the required details, choose the payment method and press the order confirmation button, which involves an obligation to pay. Before confirming you can check and correct the details you entered. The contract is concluded when you receive the order confirmation email. We reserve the right not to accept an order, refunding any amount paid, if the product is not available or if the details are incomplete or incorrect.<\/p>\n

6. Payment<\/h2>\n

You can pay with your PayPal account, by credit or debit card, with Apple Pay or with Google Pay. All payments are processed by PayPal: card details are entered in secure fields provided by PayPal or on its pages and are never transmitted to or stored on our systems. You can also pay in 3 instalments<\/strong> with PayPal, subject to PayPal's approval: in this case PayPal pays us the full amount and the terms of the instalment payment are governed between you and PayPal.<\/p>\n

7. Shipping and delivery<\/h2>\n

Delivery times, costs and areas are listed on the Shipping<\/a>page. The risk of loss of or damage to the products passes to the consumer only when they take physical possession of the goods.<\/p>\n

8. Right of withdrawal<\/h2>\n

If you are a consumer you may withdraw from the contract within 14 days<\/strong> of delivery, without giving any reason. Procedure, exceptions and refunds are described on the Returns and refunds<\/a>page, where you will also find the withdrawal form.<\/p>\n

9. Legal guarantee of conformity<\/h2>\n

All products are covered by the legal guarantee of conformity under articles 128 and following of the Italian Consumer Code, valid for 24 months from delivery<\/strong> for consumers. In case of a lack of conformity you are entitled to have the goods repaired or replaced free of charge or, where provided by law, to a price reduction or to terminate the contract. The defect must be reported within two months of its discovery by writing to info@artechmotorsport.com with your order number and a description of the problem.<\/p>\n

The guarantee does not cover damage caused by incorrect installation, incorrect electrical connections, improper use or use other than intended, modification or tampering with the product. For purchases made with a VAT number, the warranty provided by the Italian Civil Code applies.<\/p>\n

10. Liability<\/h2>\n

To the extent permitted by law, we are not liable for damage resulting from installation, configuration or tuning carried out by third parties or by the buyer, nor for the use of the products in breach of road traffic rules. This does not affect consumer rights that cannot be limited by law.<\/p>\n

11. Personal data<\/h2>\n

Personal data provided with the order is processed as described in thePrivacy policy<\/a>.<\/p>\n

12. Governing law and jurisdiction<\/h2>\n

The contract is governed by Italian law. For consumers, the competent court is that of the consumer's place of residence or domicile, if in Italy; any more favourable provisions of the consumer's country of residence remain applicable. For purchases made with a VAT number, the Court of Trento has exclusive jurisdiction.<\/p>\n
